Intern Housing Contract Agreement

All capitalized terms in these Terms and Conditions will have the meaning given to them in the Application and Registration for Intern Housing. The Application and Registration for Intern Housing, together with these Terms and Conditions, will be called the “Agreement.”  

Additional terms may apply to contracted groups or individuals and may not be reflected on this page.

  1. RENTAL AGREEMENT. Tenant may occupy the Space during the agreed upon dates at the Rental Fee specified in the Application and Registration for Intern Housing completed by Tenant and accepted by University. The Summer Term will generally run from mid-May through mid-August each year and the specific occupancy (start) and vacancy (end) dates will be defined in the Application and Registration for Intern Housing each year. All Space governed by this Agreement must be vacated by the last date defined in the Agreement for that rental year. University will have the right upon reasonable notice to relocate Tenant to alternative housing accommodations on the University campus.

  2. RULES AND REGULATIONS. Tenant will occupy the Space and use the Residence Hall in accordance with the Agreement, all University policies, rules and regulations (including but not limited to prohibitions on pets, smoking, alcohol, gambling, and firearms), Office of Residence Life Guidelines, and all applicable federal, state, and local laws, ordinances, rules, and regulations. University reserves the right to amend the Residence Life Guidelines at any time, provided that no such amendment will affect Tenant’s rights under the Agreement.

  3. COVID-19. Tenant is required to meet the federal, state, local, and University requirements regarding COVID-19 and COVID-19 vaccinations. University reserves the right to amend the COVID-19 requirements at any time.

  4. UTILITIES AND SERVICES. University will provide a climate-controlled environment, electricity, water/sewer services and trash removal; and will be responsible for all major maintenance and repairs to the Space in an efficient and timely manner. Tenant will deposit trash and recyclable materials in the designated trash receptacles and area and must keep the Space in good clean condition and order. A deep cleaning fee may be assigned to the Tenant by Hospitality & Event Services following the Tenant's departure in the event that the Space is found in poor condition.

  5. DAMAGE AND LOST KEY/CARD BILLING. Tenants will be held responsible for any and all damages found in their Space during the checkout process. If determination of who is responsible for damage within a Space/suite/apartment is not made, all Tenants of that unit will be held responsible. Common area damages may be assessed by the University to the Tenants of floors and buildings. Tenant will be held responsible for any lost key(s) and/or card(s). A lost key or card fee may be assigned to the Tenant by Hospitality & Event Services in the event that a key or card is reported missing by the Tenant or found missing following the Tenant's departure.

  6. PAYMENT. The application deposit is non-refundable. Full payment of the Rental Fee must be made upon the University’s approval of this Agreement.

  7. CANCELLATION. Cancellations must be made in writing. Tenants who cancel a submitted Agreement no later than (2) weeks after paying their deposit may be eligible to receive a 50% refund of the fully paid Rental Fee.

  8. ASSIGNMENT OF SPACE. Space in University housing will be assigned on the basis of Tenant preference, subject to the availability of space and the reasonable ability of the University to match the request with available space. The University does not discriminate on the basis of ability, age, ethnicity, gender, gender expression, ideology, national origin, race, religion, sex, sexual orientation, socio-economic status or veteran status in any of its policies or practices, but reserves the right to assign separate accommodations to honor the self-identified gender preferences of all Tenants. Reasonable arrangements for Tenants living with disabilities are available by contacting the Office of Hospitality & Event Services. This Agreement is an agreement for an assignment in on-campus housing and is not an offer for a particular space or with a particular Spacemate.

  9. GUESTS OR ASSIGNMENT. Tenants must abide by the Guest and Visitor Guidelines outlined by UMass Lowell Residence Life, including the requirements for registering all guests in the Intern Housing Portal, carrying valid picture ID at all times, and producing that identification when requested by any University personnel. Additionally, Tenants must assume full responsibility and liability for their guests’ adherence to UMass Lowell Summer Intern Housing policies, and the Tenant will be held responsible for any action taken by their guests that violates those policies. Tenant agrees to reimburse University for all damages and/or excessive cleaning charges to the residence hall caused by Tenant’s guests. University assumes no responsibility for accidents and/or loss of property incurred by Tenant’s guests. Tenant may not assign this Agreement or sublet the Space.
    Guests must be signed in by the Tenant no later than 10:30 PM at the Riverview Suites front desk. Tenants are permitted to sign in no more than (2) overnight guests with the express consent and understanding of their Spacemate(s). Tenant will not permit persons to stay in the Space overnight for more than (2) consecutive nights within a (10) day period. In rare circumstances, a resident may request permission for an extended stay which if approved would allow their guest or visitor to spend more than two (2) consecutive nights within a seven (7) day period in their residence hall. This request should be made by emailing UMass Lowell’s Hospitality & Event Services with an explicit request outlining the circumstances surrounding the extended stay.

  10. CHECK-IN. Upon move-in, each Tenant will be issued access to a Space via key and/or card, and other pertinent information.

  11. CHECK-OUT. Check-out, whether a Tenant is changing Spaces or leaving University housing altogether, includes returning the Space key (where applicable), removing all personal belongings and trash, and leaving the Space in an acceptable, clean and undamaged condition. Personal property not removed by Tenant at the expiration or earlier termination of this Agreement will be considered abandoned and the University may dispose of it as it deems expedient without liability to Tenant. Storage for personal items is not available.

  12. SPACE CHANGES. Tenants requesting a Space change must seek approval from Hospitality & Event Services staff. Space change requests should be made in writing with the Office of Hospitality & Event Services. Unauthorized Space changes will result in termination of this Agreement.

  13. CARE/CLEANLINESS OF TENANT SPACES. The Tenant assumes responsibility for the cleanliness and care of the Space and its furnishings. Reasonable safety and sanitation standards must be maintained. Tenants may not dismantle, refinish, paint, dye, or in any way alter the Space or its furnishings without specific permission from Hospitality & Event Services.

  14. RIGHT TO ENTRY. The University recognizes and respects the Tenant’s right to privacy and desire to control their own living environment. However, the University is also responsible for assuring that Tenants maintain their Spaces in a safe and sanitary manner, and for making necessary repairs to the Spaces and their furnishings. Therefore, the University reserves the right to enter Tenant’s Space without prior notice for the purpose of safety and/or maintenance (emergency or Tenant requested). In addition, the University reserves the right to enter a Space when state, local, or federal laws, and /or the UMass Lowell Tenant Conduct Code, as related to the safety or wellbeing of a Tenant or member of the community, is suspected to be in violation. Whenever possible the University will attempt to provide the Tenant with advance notice.

  15. UNAUTHORIZED USE AND POSSESSION OF KEYS. Only Tenants and authorized staff are permitted to have keys and/or access cards to the residence halls and Spaces within the residence halls. Any non- resident, non-Tenant, or unauthorized person found having a key and/or access card to a residence hall or Space within a residence hall may be referred to the University Tenant Conduct system and/or to local authorities. Hospitality & Event Services may only duplicate keys for on-campus housing Spaces.

  16. RIGHT TO REASSIGN OR TERMINATE AGREEMENT. The University reserves the right to terminate this Agreement or reassign Tenants to alternative housing arrangements under the following circumstances: a) in an emergency which would not permit the continued operation of the residence halls, b) when a Tenant is found to have violated University policies or regulations, c) if Tenant fails to comply with the terms of this Agreement, d) if Tenant fails to meet residence hall eligibility requirements, e) if an irreconcilable situation exists between Spacemates. In no event will University be liable to Tenant or others for any damages, of whatever nature, including without limitation, consequential, direct, indirect, general or lost profits resulting from University’s reassignment of Tenant’s housing or University’s termination of this Agreement.

  17. INSURANCE. The University is not responsible for loss or damage to the personal property of the Tenant from any cause. Tenants are encouraged to confirm that Tenant’s own insurance policies (such as a family homeowner’s or renter’s insurance policy) cover such a loss.

  18. INDEMNIFICATION AND RELEASE. Tenant hereby defends, holds harmless, indemnifies and releases University from and against any and all liabilities, losses, costs and damages, including property damage, personal and bodily injury, damage or loss to or caused by Tenant, his or her family, guests, invitees, agents, assigns, visitors or licensees, or loss or damage to any property of said person in or about the Space and the Residence Hall from any cause whatsoever. Tenant’s obligations under this provision will survive the expiration or earlier termination of the Agreement.

  19. THE UNIVERSITY OF MASSACHUSETTS LOWELL RESERVES THE RIGHT TO CHANGE ANY ANDALL FEES WITHOUT PRIOR NOTICE.
