All supervisors, faculty, and administrators are expected to report any potential inappropriate sexual behavior including sexual misconduct or sexual harassment, to the Title IX Coordinator, Clara I. Please report the names, contact information, date, time and location of the potential occurrences. Please let the person you spoke with know that the Title IX Coordinator will reach out to discuss options and support resources. Your report to the Title IX Coordinator, and the person's meeting with the Title IX Coordinator, do not automatically begin a Title IX grievance process. However, the university may be required to respond to certain concerns based on the Equal Opportunity Concerns Procedure or the Title IX Grievance Procedure, even if the person does not choose to file a complaint.
Officials with Authority are employees who have the authority, on behalf of the university, to institute corrective measures for sexual harassment. They include the Title IX Coordinator, the Chancellor, the Provost, Vice Chancellors, Vice Provosts, Deans, Associate Vice Chancellors, and Assistant Vice Chancellors.
If you are an Official with Authority, you are expected to report all sexual harassment concerns to the Title IX Coordinator Clara I. Reynolds, J.D., Associate Vice Chancellor, Equal Opportunity & Outreach and Diversity & Inclusion, email: Clara_Reynolds@uml.edu, phone: 978-934-3565. This includes all relevant details including the names of all persons involved, and relevant facts regarding the alleged incident (including the date, time, and location of the event related to the concern). Officials with Authority are expected to make these reports even if the reporting person requests confidentiality, and regardless of whether a police report has been filed.
Also, Officials with Authority are required to report to the UMass Lowell Police Department, the local police department, or the Massachusetts Department of Children and Families any abuse of a minor, per M.G.L. 119, section 51A.
All other employees are asked to be active bystanders by intervening, when it is safe to do so, and reporting any potential violations of the Nondiscrimination Guidelines, including potential sexual misconduct of all types.
Requests for Confidentiality
A person with a concern or complaint cannot be guaranteed confidentiality. The university has a responsibility to respond to the extent possible to formal complaints, and potentially to some other concerns, even if a complaint is not filed. A decision to keep a concern confidential would prevent the university from fully investigating and responding to it, should it need to do so. The university may review the concern for the purpose of ending sexual harassment, preventing its recurrence, and remedying its effects. For these reasons, confidentiality cannot be assured. Only Confidential Employees can provide confidentiality. However, privacy will be maintained to the extent possible while complying with the requirements of university policies, state and federal law.
